Diese Nutzungsbedingungen („AGB“) regeln die Nutzung der Website www.domenicboernicke.com, insbesondere das Ansehen von Inhalten, den Zugang zu Fotografie-Lernangeboten, die ggf. Weiterleitung zu externen Plattformen für die Bestellung von digitalen Produkten und Prints, Newsletter-Anmeldungen sowie alle weiteren angebotenen Dienste. Mit der Nutzung der Website oder Inanspruchnahme von Diensten erklärst du dich mit diesen AGB und unserer Datenschutzerklärung einverstanden.

1. Geltungsbereich und Zustimmung

Diese AGB gelten für jede Nutzung der Website – einschließlich Lesen, Browsen, Kontaktaufnahme und der Nutzung von Links zu externen Plattformen. Mit der Nutzung der Website bestätigst du, diese AGB gelesen zu haben und ihnen zuzustimmen. Wir können die AGB gelegentlich anpassen; die fortgesetzte Nutzung der Website nach Veröffentlichung der Änderungen gilt als Zustimmung zu den aktualisierten AGB.

2. Allgemeine Webseitennutzung

- Anmeldung zum Newsletter (Double-Opt-In)

- Nutzung von Links zu externen Plattformen, über die digitale Produkte und Prints erworben werden können

- Kontaktaufnahme über die bereitgestellten Formulare

Unzulässige Nutzung

- Kopieren, Herunterladen oder Reproduzieren von Inhalten ohne Erlaubnis

- Einsatz automatisierter Tools (Scraper, Bots) zur Datenerhebung

- Übermittlung von Viren oder sonstigem schädlichen Code

- Spam, missbräuchliche Nutzung von Formularen oder Diensten

- Kommerzielle Nutzung kostenloser Inhalte ohne separate Lizenz

3. Urheberrecht

Alle Inhalte dieser Website – insbesondere Fotos, Guides, Designs und Texte – unterliegen dem Urheberrecht von Domenic Börnicke. Alle Rechte weltweit bleiben vorbehalten.

Du erhältst ein einfaches, nicht übertragbares Nutzungsrecht zur privaten Ansicht der Inhalte. Jede Reproduktion, Verbreitung, öffentliche Wiedergabe oder kommerzielle Nutzung ohne vorherige schriftliche Zustimmung ist untersagt.

Für gekaufte Produkte erhältst du ein beschränktes Nutzungsrecht zur persönlichen, nicht-kommerziellen Nutzung (siehe Produktabschnitte).

4. Produkte, externe Plattformen und Bestellungen

4.1 Digitale Produkte (Fotografie-Guides, Templates)

- Digitale Produkte können über externe Plattformen (derzeit z.B. Gumroad) verkauft und bereitgestellt werden. In diesem Fall gelten die Bedingungen, Datenschutzhinweise und Verbraucherinformationen der jeweiligen Plattform zusätzlich zu diesen AGB.

- Die Bereitstellung erfolgt in der Regel als Sofort-Download oder Streaming-Zugang nach dem Kauf.

- Aufgrund der Beschaffenheit digitaler Inhalte kann das gesetzliche Widerrufsrecht erlöschen, sobald mit dem Download oder Streaming begonnen wurde und du hierüber informiert wurdest und dem im Checkout ausdrücklich zugestimmt hast.

- Lizenz: ausschließlich zur persönlichen, nicht-kommerziellen Nutzung. Eine Weitergabe, der Weiterverkauf oder das öffentliche Teilen der Dateien ist nicht gestattet.

4.2 Prints (Bestellungen über darkroom.com und Saal Digital)

- Auf meiner Website kannst du Links zu externen Print-Plattformen (derzeit darkroom.com und das Fotoportal von Saal Digital) finden, über die Prints meiner Fotografien bestellt werden können.

- Wenn du auf einen solchen Link klickst, wirst du auf die Website des jeweiligen Anbieters weitergeleitet. Der Kaufvertrag über den Print kommt ausschließlich zwischen dir und dem jeweiligen Plattformbetreiber zustande; dieser ist Verkäufer im rechtlichen Sinne und verantwortlich für Produktion, Bezahlung, Versand, Reklamationen, Widerruf und Gewährleistung.

- Ich stelle in diesen Fällen lediglich die fotografischen Inhalte und den Link zur Verfügung und bin nicht Vertragspartner dieses Kaufvertrags; etwaige Ansprüche im Zusammenhang mit der Bestellung (z.B. Widerruf, Mängel, Lieferverzug, Rückerstattungen) sind direkt gegenüber der jeweiligen Plattform geltend zu machen.

5. Preise (Kleinunternehmerstatus)

- Aufgrund der Kleinunternehmerregelung gemäß § 19 UStG wird von mir keine Umsatzsteuer erhoben und nicht gesondert ausgewiesen.

- Sofern auf meiner Website Preise für Produkte oder Prints genannt werden, verstehen sie sich als unverbindliche Hinweise. Maßgeblich sind die im Bestellprozess auf der jeweiligen externen Plattform angegebenen Endpreise und Versandkostenregelungen.

- Eventuelle Zölle, Einfuhrsteuern oder sonstige Gebühren im Empfängerland gehen zu deinen Lasten.

- Digitale Produkte können zu Endpreisen in EUR und/oder USD angeboten werden, wie auf der jeweiligen Produktseite der Plattform angegeben.

6. Zahlungsarten

- Für Käufe, die über externe Plattformen (z.B. darkroom.com, Saal Digital, Gumroad) abgewickelt werden, gelten die dort angebotenen Zahlungsarten und Zahlungsbedingungen. Die Zahlung erfolgt jeweils direkt an die Plattform bzw. deren Zahlungsdienstleister.

- Die Zahlung ist stets vollständig im Voraus fällig, bevor Bestellungen bearbeitet werden.

- Auf meiner eigenen Website werden keine Kundenkonten für Bestellungen geführt; etwaige im Rahmen von Formularen erhobene Daten werden ausschließlich zur Bearbeitung deiner Anfrage (z.B. Kontaktaufnahme) genutzt.

7. Versand (Prints über Drittplattformen)

- Prints werden über die jeweils genutzte Plattform (z.B. darkroom.com, Saal Digital) produziert und versendet. Die konkreten Lieferbedingungen, Versanddienstleister, Lieferzeiten und Versandkosten ergeben sich aus den Informationen im Bestellprozess der jeweiligen Plattform.

- Etwaige Verzögerungen oder Probleme bei der Lieferung sind direkt mit der jeweiligen Plattform bzw. dem Versanddienstleister zu klären; ich unterstütze dich bei Bedarf gerne, bin aber nicht selbst Versender.

8. Widerrufsrecht und Rücksendungen

Digitale Produkte

- Für digitale Produkte, die über Drittplattformen verkauft werden, werden Informationen zum Widerrufsrecht (oder dessen Ausschluss) direkt im Checkout der jeweiligen Plattform bereitgestellt und richten sich nach den dortigen Verbraucherinformationen.

Prints

- Für Prints, die du über darkroom.com oder das Fotoportal von Saal Digital bestellst, gelten das Widerrufsrecht und etwaige Rückgaberegelungen der jeweiligen Plattform. Die entsprechenden Verbraucherinformationen und Widerrufsbelehrungen erhältst du direkt auf der Plattform im Rahmen des Bestellprozesses.

- Etwaige Widerrufe, Rücksendungen oder Reklamationen sind unmittelbar gegenüber der jeweiligen Plattform zu erklären. Ich bin nicht Vertragspartner dieser Kaufverträge.

9. Nutzerverhalten

Du verpflichtest dich insbesondere dazu,

- Portfolio-Bilder und Lerninhalte nicht über den erlaubten Umfang hinaus zu kopieren,

- Inhalte nicht ohne gesonderte Lizenzvereinbarung kommerziell zu nutzen,

- die Funktionsfähigkeit der Website nicht zu stören,

- keinen unbefugten Zugriff auf Systeme oder Daten zu versuchen,

- keine rechtswidrigen, beleidigenden oder unangebrachten Inhalte über Formulare oder andere Kommunikationswege zu übermitteln.

Bei Verstößen behalten wir uns vor, den Zugriff (z.B. per IP-Sperre) zu unterbinden und rechtliche Schritte einzuleiten.

10. Haftungsbeschränkung

Soweit gesetzlich zulässig gilt:

- Die Website und alle Inhalte werden „wie besehen“ ohne ausdrückliche oder konkludente Garantien bereitgestellt.

- Wir haften nicht für indirekte Schäden, Folgeschäden oder entgangenen Gewinn.

- Bei produktbezogenen Ansprüchen in Bezug auf eigene, direkt über mich abgeschlossene Verträge ist unsere Haftung auf den von dir gezahlten Betrag für die jeweilige Bestellung beschränkt.

- Für Verzögerungen oder Leistungsausfälle, die auf Drittanbieter (z.B. Zahlungsdienstleister, externe Print-Plattformen, Versanddienstleister) zurückgehen, haften wir nicht; wir unterstützen dich jedoch angemessen bei der Klärung von Problemen.

- Soweit du Verträge über Prints oder digitale Produkte direkt mit Drittplattformen schließt, haftet grundsätzlich die jeweilige Plattform nach deren Bedingungen. Meine Haftung beschränkt sich in diesen Fällen auf meine eigenen Inhalte und richtet sich nach den vorstehenden Regelungen.

11. Gewährleistung

Für alle direkt über mich gekauften Produkte gelten die gesetzlichen Gewährleistungsrechte.

- Digitale Produkte: Ist eine Datei fehlerhaft oder nicht abrufbar, kontaktiere uns bitte innerhalb von 30 Tagen nach Kauf, damit wir dir funktionsfähige Ersatzdateien zur Verfügung stellen können (sofern der Kauf direkt über mich erfolgt ist).

- Prints: Trifft ein Print, den du über eine externe Plattform bestellt hast, beschädigt oder mit Herstellungsfehlern ein, wende dich bitte zunächst an den Support der jeweiligen Plattform gemäß deren AGB und Verbraucherinformationen.

12. Beendigung der Nutzung

Wir können den Zugriff auf die Website bei Verstößen gegen diese AGB oder bei missbräuchlicher Nutzung jederzeit vorübergehend oder dauerhaft sperren. Du kannst die Nutzung der Website jederzeit eigenständig beenden.

13. Anwendbares Recht und Gerichtsstand

Es gilt ausschließlich das Recht der Bundesrepublik Deutschland unter Ausschluss der Kollisionsnormen. Soweit rechtlich zulässig, ist ausschließlicher Gerichtsstand für alle Streitigkeiten aus oder im Zusammenhang mit diesen AGB sowie der Nutzung der Website Leipzig (Amtsgericht bzw. Landgericht Leipzig).

These Terms of Use (“Terms”) govern the use of the website www.domenicboernicke.com, in particular browsing and viewing content, accessing photography learning resources, being redirected to external platforms for ordering digital products and prints, signing up for newsletters, as well as any other services offered. By using this website or any of its services, you agree to these Terms and to our Privacy Policy.

1. Scope and consent

These Terms apply to any use of the website – including reading, browsing, contacting us and using links to external platforms. By using the website, you confirm that you have read these Terms and agree to them. We may amend these Terms from time to time; continued use of the website after publication of changes will be deemed acceptance of the updated Terms.

2. General website use

Permitted use

- Viewing the photo portfolio and learning content

- Signing up to the newsletter (double opt-in)

- Using links to external platforms where digital products and prints can be purchased

- Contacting us via the provided forms

Prohibited use

- Copying, downloading or reproducing content without permission

- Using automated tools (scrapers, bots) to collect data

- Transmitting viruses or other harmful code

- Sending spam or misusing forms or services

- Commercial use of free content without a separate licence

3. Copyright

All content on this website – in particular photos, guides, designs and texts – is protected by copyright held by Domenic Börnicke. All rights worldwide are reserved.

You are granted a simple, non-transferable licence to privately view the content. Any reproduction, distribution, public display or commercial use without prior written consent is prohibited.

For purchased products, you are granted a limited licence for personal, non-commercial use only (see product sections).

4. Products, external platforms and orders

4.1 Digital products (photography guides, templates)

- Digital products may be sold and delivered via external platforms (currently, for example, Gumroad). In such cases, the terms, privacy notices and consumer information of the respective platform apply in addition to these Terms.

- Delivery usually takes place as an instant download or streaming access after purchase.

- Due to the nature of digital content, the statutory right of withdrawal may lapse as soon as you start downloading or streaming and have been informed of this and explicitly consented to it during checkout.

- Licence: for personal, non-commercial use only. Sharing, reselling or publicly distributing the files is not permitted.

4.2 Prints (orders via darkroom.com and Saal Digital)

- On my website you may find links to external print platforms (currently darkroom.com and the Saal Digital photo portal) where prints of my photographs can be ordered.

- When you click such a link, you are redirected to the website of the respective provider. The purchase contract for the print is concluded exclusively between you and the respective platform operator. That operator is the legal seller and is responsible for production, payment processing, shipping, complaints, withdrawal rights and warranty.

- In these cases I only provide the photographic content and the link and I am not a contracting party to this purchase contract. Any claims in connection with your order (e.g. withdrawal, defects, delays in delivery, refunds) must be asserted directly against the respective platform.

- Any information on typical production and delivery times on my website is for your general orientation only. The binding information is what you see in the order process on the respective platform.

5. Prices (small business status)

- Due to the small business regulation pursuant to § 19 of the German VAT Act (UStG), I do not charge VAT and do not show VAT separately.

- If prices for products or prints are mentioned on my website, they are non-binding indications only. The decisive prices and shipping cost rules are those shown in the order process on the respective external platform.

- Any customs duties, import taxes or other fees in the recipient’s country are borne by you.

- Digital products may be offered at final prices in EUR and/or USD, as stated on the individual product pages of the platform.

6. Payment methods

- For purchases processed via external platforms (e.g. darkroom.com, Saal Digital, Gumroad), the payment methods and payment terms offered there apply. Payment is made directly to the platform or its payment service providers.

- Payment is always due in full in advance before orders are processed.

- No customer accounts for orders are created on my own website. Any data collected via forms is used solely to handle your enquiry (e.g. to respond to a contact request).

7. Shipping (prints via third-party platforms)

- Prints are produced and shipped by the respective platform used (e.g. darkroom.com, Saal Digital). The specific delivery conditions, shipping providers, delivery times and shipping costs are set out in the information provided during the order process on the respective platform.

- Any information on typical production and shipping times on my website is for general guidance only. The binding information is what you see during checkout on the platform.

- Any delays or issues with delivery must be resolved directly with the respective platform or shipping provider. I am not the sender of the goods, but I am happy to support you in resolving issues where possible.

8. Right of withdrawal and returns

Digital products

- For digital products sold via third-party platforms, information on the right of withdrawal (or its exclusion) is provided directly during checkout on the respective platform and is governed by the consumer information provided there.

Prints

- For prints ordered via darkroom.com or the Saal Digital photo portal, the right of withdrawal and any return policies of the respective platform apply. The relevant consumer information and withdrawal instructions are provided to you directly on the platform during the order process.

- Any withdrawals, returns or complaints must be addressed directly to the respective platform. I am not a contracting party to these purchase contracts.

9. User conduct

In particular, you agree to:

- not copy portfolio images and learning content beyond the permitted scope,

- not use content commercially without a separate licence agreement,

- not interfere with the proper functioning of the website,

- not attempt unauthorised access to systems or data,

- not transmit unlawful, offensive or inappropriate content via forms or other communication channels.

In the event of violations, we reserve the right to restrict or block access (e.g. via IP blocking) and to take legal action.

10. Limitation of liability

To the extent permitted by law, the following applies:

- The website and all content are provided “as is” without express or implied warranties.

- We are not liable for indirect or consequential damages or loss of profit.

- For product-related claims in connection with contracts concluded directly with me, our liability is limited to the amount you paid for the respective order.

- We are not liable for delays or failures in performance caused by third parties (e.g. payment service providers, external print platforms, shipping providers). However, we will provide reasonable support in helping you resolve issues.

- Where you enter into contracts for prints or digital products directly with third-party platforms, the respective platform is generally liable in accordance with its terms. In such cases, my liability is limited to my own content (e.g. incorrect or misleading descriptions on my website) and is governed by the provisions above.

11. Warranty

For all products purchased directly from me, the statutory warranty rights apply.

- Digital products: If a file is defective or cannot be accessed, please contact us within 30 days of purchase so that we can provide you with working replacement files (provided the purchase was made directly from me).

- Prints: If a print ordered via an external platform arrives damaged or with manufacturing defects, please first contact the support team of the respective platform in accordance with its terms and consumer information.

12. Termination of use

We may temporarily or permanently restrict or block access to the website in case of violations of these Terms or misuse. You may cease using the website at any time on your own initiative.

13. Applicable law and place of jurisdiction

These Terms and any disputes arising out of or in connection with them or the use of the website are governed exclusively by the laws of the Federal Republic of Germany, excluding its conflict of law rules. Where legally permissible, the exclusive place of jurisdiction is Leipzig, Germany (Local Court or Regional Court of Leipzig).
